These conditions of sale are valid only between the company Avioincar, Via Sabbioni, 8 38063 Avio (TN) Chamber of Commerce n. 13692/1998 - P.IVA 01606030227 and any person or company that shops online on the website www.avioincar.it, hereinafter referred to as "CUSTOMER". These conditions may be subject to change at any given time. These terms and conditions aim to govern the purchases made on the site www.avioincar.it, in accordance with Articles 50 and following of Legislative Decree no. 206 of 6/09/05, the Consumer Code, Section II, Chapter I of Title III of the third party, to which reference should be made according to art. 60 of the Consumer Code.

ARTICLE 1: The Purpose of the contract. With these general conditions of sale, Avioincar sells through the site e-commerce www.avioincar.it, and the CUSTOMER remotely buys the property listed on the site. The contract is concluded exclusively through the Internet, by accessing the client's address www.avioincar.it and by placing a purchase order in accordance with the procedure laid down by the site itself.

ARTICLE 2: Conclusion and effectiveness of the contract. The sale wil be finished the moment Avioincar sends an e-mail confirmation of the order and confirmation of receipt of payment to the CUSTOMER. The e-mail contains the details of the CLIENT, the items purchased, the price of goods, transport costs, the information relating to the payment, the billing address and shipping address to which the goods will be delivered. The CLIENT agrees to verify the correctness of the data present in it, and to communicate any corrections to be made by Avioincar. Avioincar agrees to describe and present the items sold on the site in a comprehensive manner, taking into account that the photographs of the presented products on www.avioincar.it do not constitute part of a contract, as they only serve as a suggestion. Avioincar also agrees to deliver the goods ordered within 30 days from the day following the day of receipt of payment from the CUSTOMER. Considering the contracts signed by Avioincar and by express courier GLS, the goods usually leave the warehouse within 24-48 hours from the moment the payment is received. No telephone talks are allowed between CUSTOMER and employees or consultants of Avioincar, and only the agreements signed through the website or by e-mail are considered to be authentic and valid.

ARTICLE 3: Availability of products. The availability of the products applies to the moment when the CLIENT consults the tabs of the product; this must be considered as indicative only, because due to the simultaneous presence of multiple users on the site www.avioincar.it, the products could be sold to others before confirming the order. Even after sending the e-mail confirmation of the order by AVIOINCAR, there may be a partial or total unavailability of the goods. In this case, the CUSTOMER will be promptly informed and can decide whether to accept the delivery of the products that are currently available and accept that AVIOINCAR, at its own expense, to then send the material ordered in several packaged to complete the initial order, or to ask for a cancellation of the order, and this should be done via e-mail to customer service. ARTICLE 4: Payment. Any payment by the CUSTOMER may only take place through the payment methods indicated on the sitowww.avioincar.it. ARTICLE 5: Prices. All selling prices of the products on display are clearly indicated on the website, they are expressed in Euros and include the VAT. Shipping and handling charges are not included in the purchase price, unless otherwise specified, as these fees are indicated and calculated at the end of the purchasing process, right before the payment is made. The CUSTOMER agrees that AVIOINCAR has the right to change prices of items at any given time, however, the goods will be invoiced based on the prices listed on the site at the time of the order, and confirmed in the e-mail sent by AVIOINCAR as confirmation of the order. The price paid does not bind AVIOINCAR on future purchases by the CUSTOMER.

Article 6: Right of withdrawal. In accordance with the legal provisions in force, the CUSTOMER has the right to cancel the purchase without penalty and without specifying the reason, within 10 days from the moment the goods are delivered. If the CLIENT decides to exercise this right, he must proceed by visiting the "My Orders" tab in their account. The goods must be returned to avioincar.it at the store AVIOINCAR, in Via della Musia, 101 25135 Brescia. By law, the shipping costs for the return of the purchased items are charged to the CUSTOMER. The goods must be returned undamaged, in original packaging, complete with all their original parts (including packaging and any documentation and original accessories), as well as the complete documentation of the tax attached. AVIOINCAR will refund the amount of the products covered by the withdrawal as soon as possible and within a maximum time of 30 days from the moment the goods have reached the Avioincar shop. In case the received products do not comply with the order placed by the customer or the products are damaged or defective in any way, the CUSTOMER must notify AVIOINCAR promptly via the e-mail customer service of the company, within maximum period of 30 days. Subsequently, the CUSTOMER must proceed to returning the goods exactly as instructed above, through his personal account on the site avioincar.it, and mention whether they want to replace the items or if they would like to get a refund. AVIOINCAR will contact the courier who will collect the goods at the address you have indicated in the purchasing process. AVIOINCAR reserves the right to verify the non-compliance aspects mentioned by the customer, and if they confirm then the company will ship the replacement goods or issue a refund by crediting the amount of purchase.


ARTICLE 7: Product Warranty. All products presented on the site www.avioincar.it benefit from a legal and contractual guarantee of 12 months, in accordance with current legislation. In order to qualify for the guarantee, the CUSTOMER must keep the invoice attached to the supply.

ARTICLE 8: Method of delivery. AVIOINCAR only accepts orders that will be delivered on Italian territory. The products will be delivered by courier to the address indicated by the Client at the time of the order. For every order placed on the website www.avioincar.it, AVIOINCAR emits regular invoice of the material as well as attach the invoice to the material itself, or send it by mail to the address indicated by the Client at the time of the order. Once the invoice has been issued, you can not make any changes to the data shown in the documents.

ARTICLE 9: Liability. AVIOINCAR assumes no liability for disruptions caused by any major force or unforeseeable circumstances, or in the case of a massive disruption of the Internet, in case you are unable to execute the order within the time stipulated in the contract. The availability of each item is for guidance only, is not contractual and the responsibility cannot be attributed to AVIOINCAR, if one or more of the products displayed on the online shop turns out to be unavailable.

ARTICLE 10: Access to the site. The Client has the right to access the site for consultation and for placing purchase orders. The Client is not allowed to use the website or any of its contents for any other purpose, especially commercial. The integrity of the elements of this web site, whether audio or visual, as well as all the related technology remain the property of AVIOINCAR and are protected by intellectual property rights.

ARTICLE 11: Cookies. The www.avioincar.it site uses "cookies". Cookies are electronic files that record information about the navigation history of the CUSTOMER on the site, such as the pages he has visited, the date and the time when he visited them.

ARTICLE 12: How to follow an order. It is possible for the Client to check the shipping status of an order online via TNT. The client can easily do so by simply clicking on the order, directly from their account. After that, the client will immediately receive the tracking number for the order. Upon clicking on the tracking number, the Client will be connected to the TNT website where he can effortlessly track the shipment.

ARTICLE 13: Wholeness. These general conditions of sale are made by all of the terms.


Article 14: Applicable law and competent jurisdiction. These general conditions of sale are subject to Italian law. Any dispute that can not find amicable solution regarding the interpretation, validity, execution of these general conditions and individual sales contracts governed by these, is attributed to the exclusive jurisdiction of the Court of Brescia, with the express exclusion of any alternative forum.
